Benefits
For All The Smiles LLC provides a clear, BPA-Free plastic for all retainers and guards. The removable appliance permits normal eating, brushing, and flossing without any disadvantages. Risks
For All The Smiles LLC Clear retainers and guards may involve some dangers and are not suitable for all clients. These could include and not limited to::
Allergic Reaction – Some customers may develop an allergy to the materials used to construct your retainers and guards. If you develop an adverse reaction, please discontinue use immediately and tell us and your primary care physician.

Cavities, Gum, or Periodontal Disease – During the use of retainers and guards, cavities, tooth decay, periodontal disease, inflammation of the gums, and permanent markings (e.g. decalcification) may arise or accelerate. These reactions are more likely to occur if you consume a lot of sugary foods or beverages, do not brush and floss your teeth before putting on the retainers and guards, or do not visit your dentist at least every six months for preventative checkups. In other cases, discoloration or white patches may also appear; minor cavities may enlarge, producing sensitivity and, in some cases, discomfort or tooth fracture; gingival inflammation may rise, resulting in irritation or bleeding. If underlying periodontal diseases are left untreated, they may spread and cause tooth loss. You may be required to discontinue wearing your retainers and guards. All of these symptoms necessitate consultation with a dentist of your choosing.
Damage to Nerves in Teeth – Tooth movement may hasten nerve damage or nerve death, resulting in the need for a root canal, additional dental procedures, or tooth loss. This is due to short crowns of your teeth. Please stop wearing your retainers and guards if you experience any pain or discomfort.
Wisdom Teeth - In the vast majority of cases, customers with wisdom teeth can have retainers and guards For All The Smiles LLC appliances. The customer should speak with his or her primary dentist or oral surgeon to establish the necessity and timing of wisdom teeth extraction. Please be advised that your customize retainers and guards provided may not extend to cover third molars (wisdom teeth) if present. The efficacy and coverage of the your retainers may vary depending on individual's dental anatomy, retention, oral conditions. If retainers ro guards purchase through our website is giving you pain. Please stop wearing them, contact our customer service, and seek immediate attention with your local dentist. Please note that the overall shape of the product may vary due to individual differences in the shape and size of the arch and teeth. If you have any concerns or specific requirements, please feel free to discuss them with our team
Do Not Use the product if you have the following conditions:
- Severe open bites, severe overjet, severe overbite, tooth malocclusion requiring surgical correction, mixed dentition (both baby and adult teeth), dental prosthetics or dental implants, active periodontal disease, active tooth decay or dental caries, permanent retainers, mental illness, or allergy to PETG material.
- Caution: In rare cases, some individuals may be allergic to the plastic aligner material or other elements involved. If you are among them, discontinue use immediately and call a medical professional immediately. Accidental ingestion or aspiration of retainers and guards may be hazardous.

Retainers and Guards Risks Overnight Wear - Overnite wear of retainers and guards by For All The Smiles LLC is susceptible to each of the dangers listed here. Other Risks and Warnings
It is not meant to substitute regular dental examinations and dental care by All The Smiles LLC. Retainers and guards may cause tooth mobility and probable dangers and adverse effects. Duration and Results

Future Retainers

To qualify for our Guarantee, you must: 1) get retainers from either (a) For All The Smiles LLC or (b) another source (so long as you keep and show valid proof of purchase on annual basis after your last retainer purchase from For All The Smiles LLC.) Proof of purchases from other sources must also be given to For All The Smiles LLC within 45 days of purchase by submitting a support ticket, and 2) you must certify annually that you are actively utilizing your retainers as recommended.
Impression Kit
Rarely, individuals may experience an allergic reaction to the Impression Kit's components. Please contact For All The Smiles LLC for a detailed list of components if you have any questions. Damage or loss of tooth structure, crowns, bridges, implants, bonded retainers, or other dental procedures is possible with any dental impression. For All the Smiles LLC is not responsible for damages. Please do not submit partials using the Impression Kit.
Do not consume the Impression Kit contents. Please get medical assistance if you do so and encounter any health complications. As with everything placed in the mouth, there is a risk of choking; please practice the necessary caution.
Active periodontitis patients and have active known tooth infections are NOT eligible for For All The Smiles LLC retainers and guards..
Whitening Risks
Type of Discoloration – The teeth whitening system does not lighten all teeth or dental restorations. Blue, gray, multicolored, and striped discolorations may not be amenable to whitening. If you have periodontal disease or gum recession, the portion of the tooth at the gum line may not respond to whitening. Likewise, fillings, cavities, and other damage do not lighten. Additionally, the use of cigarettes, wine, coffee, tea, and other staining agents will impede the whitening process.
White/Tooth-Colored Fillings — White or tooth-colored fillings will not become lighter or softer after using the whitening procedure. These fillings may require replacement following tooth whitening or if they become mushy.
Pregnancy - For pregnant or potentially pregnant women: I accept that in order to initiate or maintain wearing retainers and guards during pregnancy, I must first acquire authorization from my treating doctor. Although I am not required to submit this authorization to For All The Smiles LLC, I acknowledge that it is my responsibility to consult with my doctor before to initiating or continuing wearing retainers and guards process during pregnancy.
Sensitivity and Irritation – Excessive usage of a whitening system may cause gum discomfort, as well as throat irritation if the whitening agent is swallowed. Initial use may cause sensitivity of the teeth. In addition, whitening solution that seeps into broken or cracked tooth fillings can cause discomfort and possibly irreversible nerve damage.
Reversible - Whitened teeth can eventually discolor again. Reducing certain foods and beverages will lessen tooth discoloration.

By default, records are kept securely under strict HIPAA regulations. If you choose for For All the Smiles LLC to delete all your digital records. Informed Consent
By signing my Informed Consent, I am aware that I am attesting to the following: My teeth were cleaned by a dentist. My teeth were x-rayed by my dentist. My dentist examined and corrected cavities, loose or faulty fillings, crowns, and bridges. My dentist examined my x-rays and determined that I do not have any shorter or resorbed roots. My dentist examined my x-rays and determined that none of my teeth are impacted. My dentist has examined my gum pockets and determined that I do not have periodontal disease or gum disease. In the past six months, my dentist has completed a comprehensive oral cancer screening, and I do not have oral cancer. There are no current active infections in my mouth and I went to my local dentist to have a comprehensive exam. There is no discomfort in any of my teeth. I have no jaw discomfort. I do not have loose teeth, present or known cavities. No "baby teeth" remain in my mouth, and all of my permanent teeth are there. I further agree that if a For All The Smiles LLC Dental Professional supervising my retainers and guard determines that extra observation by my personal dentist is required, I will schedule an appointment and re-certify an attestation within 30 days of receiving the concern from a For All The Smiles LLC Dental Professional. I am also aware that while taking impressions at home, please be aware that there is a possibility that impression taking, putty may cause dislodgment of bridges, crowns, veneers, and or fillings. For All The Smiles LLC is not responsible for any such occurrences. If you feel you have any loose crowns, bridges, veneers, or fillings, please seek immediate attention from your local dentist before taking impressions for your retainers or guards with our home Impression kit.
I attest that I am able to read and comprehend English. In opting to join into a participation agreement with For All The Smiles LLC, I am aware of the risks, rewards, and alternatives outlined above. In addition to discussing the information provided in this form with wearing retainers and guards and providing my written consent by signing this form, I may be required to offer oral consent or other kinds of consent in accordance with the laws of my local state. I freely consent to participate in wearing retainers and guards that For All The Smiles LLC provides, having been informed of the treatment's risks and disadvantages. I am aware that wearing retainers and guards includes the provision of health or dental care evaluation, diagnosis, consultation, treatment, electronic and/or oral transfer of dental information or photographs and, if required, medical information to a participating licensed dental professional within my state. I realize that in order for this process to continue, For All The Smiles LLC will share my personal and medical information with third parties, business associates, or other persons for the purposes of diagnosis, aligner and treatment plans, and product production, and I consent to this sharing. For All The Smiles LLC and its affiliates have not provided me with any guarantees or assurances. After reading this form, I have a complete understanding of the benefits and dangers associated with my treatment using For All The Smiles LLC retainers and guards whitening system. I am aware that no particular results or consequences are guaranteed. Before signing, I spoke with a dentist about the For All The Smiles LLC retainers and guards and was given the opportunity to ask questions about the use of retainers and guards and For All The Smiles, LLC. By checking this box before check out, I acknowledge that my questions have been satisfactorily addressed. I am also aware that the For All The Smiles LLC retainers and guards will not or may correct any current biting issues. I realize that if I wish to correct any bite condition, I will need to seek dental guidance from a separate dental practitioner, possibly an orthodontist because, although my teeth will be protected, any prior bite condition will possibly remain compromised after my For All The Smiles LLC participation in For All The Smiles LLC retainers and night guards.

Agreement to Arbitrate and Class Action Waiver
I thus attest that I have read and agreed to the terms of For All The Smiles LLC's Agreement to Arbitrate and Class Action Waiver, and that I have carefully considered the repercussions of this important decision. I agree that any dispute regarding the products and services offered by For All The Smiles LLC and/or affiliated dental professionals, including but not limited to medical malpractice disputes, will be determined on an individual basis (and not as a class, representative, or collective action) by submission to arbitration in accordance with the attached Agreement To Arbitrate and Class Action Waiver, and not by a lawsuit brought in any court, except for individual claims within the jurisdiction of Small Claims Court. I understand that I must send a Demand for Arbitration in accordance with the accompanying Agreement to Arbitrate Form in order to commence the arbitration. I accept that the arbitration will be presided over by a single, impartial arbitrator selected by the parties and will be settled in accordance with the rules of the American Arbitration Association.
Exchanges and Returns
If you receive a damaged product, please contact us and submit a support ticket so that we can replace it.Due to safety concerns, we do not accept returns. Video/Photograph Release
Without the hassle of surgery or braces, For All The Smiles, LLC makes it simple to maintain a beautiful smile. I grant For All The Smiles LLC ("For All The Smiles LLC") the irrevocable right and permission to use photographs and/or video recordings of me for the purposes of creating photographs or video clips, as well as stand-alone pictures/graphics in which I may appear and/or be heard, for use in internal For All The Smiles LLC publications and for the purpose of training For All The Smiles LLC employees. For All The Smiles LLC will limit its use of images and video recordings to internal websites and publications. For All The Smiles LLC agrees that no images or video clips will be published on social media or any other public media outlets. These recordings are only for training purposes and internal usage only.
I am aware that images and/or videos of me may be posted on For All The Smiles LLC's internal websites, and I consent to this. I also understand and accept that I may be identified by name and/or title in internal written, online, or broadcast information that may accompany images and/or video recordings of me. I renounce my right to review the final output. I agree that these portraits, images, photographs, video and audio recordings, and all reproductions thereof, as well as all plates, negatives, recording tapes, and digital files are and shall remain the property of For All The Smiles LLC.
I hereby release, absolve, and forever discharge For All The Smiles LLC, its current and former directors, agents, officers, and employees of the above-mentioned entity, its affiliates, and assigns from any and all claims, demands, rights, promises, damages, and liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, appropriation of likeness, or defamation.
I certify that I am at least eighteen (18) years old and of legal age to establish a binding contract in my own name, or that my parent or legal guardian has completed a parental release form on my behalf. This release is enforceable against me, my heirs, assigns, and personal representatives.
Binding Arbitration
All disputes between For All The Smiles LLC and You will be arbitrated. In contrast to a court case, arbitration is less formal and aims to settle disagreements faster. The dispute will be handled by a neutral arbitrator who has the authority to provide the same damages and relief as a court may instead of a judge or jury. You are giving up your rights to have your case decided by a jury and to take part in a class action lawsuit against For All The Smiles LLC by agreeing that any arbitration under this agreement will only be conducted on an individual basis; class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not permitted. If any part of this arbitration agreement is deemed to be unenforceable, the remainder of the arbitration conditions will still be enforceable (but in no case shall there be a class arbitration). According to this clause and the relevant arbitration rules for that venue, all Disputes shall be ultimately and solely decided by binding individual arbitration conducted by a single arbitrator under the administration of ADR Services, Inc.
Consumer claimants (those whose transaction is for personal, family, or home use) may decide to take their case to court rather than arbitrate it. Full application of the Federal Arbitration Act, 9 U.S.C. 1-16, is made. Any arbitration hearing will take place in the county or parish where you now reside if you are a consumer filing a claim pertaining to personal, home, or family usage. Otherwise, any arbitration hearing shall be held any venue as the parties may agree upon or the arbitrator may determine. The arbitrator's decision is final and binding on the parties, and it can be used as legal evidence in any court with appropriate jurisdiction. In the event that you win a claim for which you are lawfully entitled to attorney's fees, the arbitrator may allow you to recoup those costs.
Unless the arbitrator finds that your claim was frivolous, For All The Smiles LLC will not ask for payment of its legal costs in connection with any claim for which you are asking for relief. You and For All The Smiles LLC, as used in this arbitration clause, also relate to their respective subsidiaries, affiliates, agents, staff members, predecessors, successors, and assigns.
Unless otherwise required by law, you have one year from the date the cause of action accrues to file any action or continue in relation to any Dispute.
Governing Law/Jurisdiction
These terms and conditions and the transactions contemplated hereby shall be governed by, and construed and interpreted in accordance with, the laws of the State of California. Any action seeking legal or equitable relief arising out of or relating to these Terms will be brought only in the courts of the State of California..
Severability and Survival
If any provision of this Arbitration Agreement is deemed to be unenforceable or unlawful for any reason, then the entire agreement shall be null and void.
The unlawful or unenforceable provision shall be severed from these terms;
The severance of the unenforceable or illegal section shall have no effect on the remainder of the Arbitration Agreement or the parties' rights to compel arbitration of any remaining claims on an individual basis pursuant to the Arbitration Agreement; and
Insofar as any claims must proceed on a class, collective, consolidated, or representative basis, such claims must be litigated in a civil court of competent jurisdiction and not in arbitration, and the parties agree that litigation of those claims shall be stayed pending the outcome of any individual claims in arbitration.

As part of your treatment, we partner with Invisalign, a Align Technology Company to provide Vivera Retainers. Invisalign uses your dental impressions to create digital scans, which are securely stored in their system for the purpose of fabricating your retainers. This process ensures that future retainer replacements can be efficiently produced without the need for new impressions. If at any point you decide that you do not wish for Invisalign or our company to retain your dental scans, you may request that they be deleted from our system.
